Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AttendIn website, applications, and services (the "Platform") provided by AttendIn Ltd ("AttendIn", "we", "us"). If you use the Platform on behalf of an organisation, you confirm you have authority to bind that organisation and "you" refers to that organisation.
By accessing or using the Platform, creating an account, accepting an invitation, or clicking to accept these Terms, you agree to be bound by them.
These Terms incorporate the documents below (together, the "Agreement"):
- Privacy Policy (and any Cookie Policy)
- Any plan-specific terms or order forms (Beta, Basic, Pro, Enterprise)
- Any Data Processing Agreement (DPA) or security addendum (where applicable)
- Any event-specific terms set by an organiser (where presented to you)
1. Definitions
- "Account" means your AttendIn user account.
- "Customer Data" means data and content uploaded to the Platform, including event details, attendee data, contact lists, messages, files, images, and branding.
- "Organiser" means a user or organisation that creates and manages events on the Platform.
- "Attendee" means a user or invitee who registers for or attends an event.
- "Invite" means an email or link used to invite an Organiser, Delegate/Co-ordinator, or Attendee to access an event or the Platform.
- "Feedback" means suggestions, bug reports, comments, reviews, and other feedback you provide about the Platform.
2. The Platform
AttendIn provides tools to create and manage events, communicate with invitees and attendees, facilitate networking, and related features. We may update, add, remove, or modify features over time.
3. Eligibility and account creation
You must provide accurate information, keep it up to date, and maintain the confidentiality of your credentials. You are responsible for all activity under your Account.
Accounts may be created through (a) website sign-up, or (b) accepting an Invite and completing one-time passcode (OTP) verification.
4. Acceptable use
You must not:
- Use the Platform unlawfully or in a way that infringes rights of others;
- Harass, abuse, threaten, or harm others;
- Upload or transmit malware, attempt to probe or breach security, or disrupt the Platform;
- Scrape, reverse engineer, copy, or access the Platform in an unauthorised manner;
- Misrepresent your identity or your authority to act for an organisation.
5. Organiser responsibilities and contact lists
If you are an Organiser (or acting for an Organiser), you are responsible for your events, event content, pricing, refunds and attendee communications, and compliance with applicable laws.
If you upload contact lists (including invitees, attendees, delegates, speakers, sponsors, staff, or co-ordinators), you confirm that:
- You have the lawful right and appropriate permissions to upload and use those contacts for event-related communications;
- You will comply with applicable privacy, e-marketing, and anti-spam laws, including honouring opt-outs where required;
- You will not upload sensitive personal data unless strictly necessary for the event and permitted by law;
- You are responsible for the content, timing, and compliance of messages you send using the Platform.
We may provide tools such as unsubscribe links and suppression lists. You agree to use them appropriately.
6. Attendee responsibilities
If you are an Attendee, you are responsible for the accuracy of information you provide and for complying with any event-specific terms.
7. Customer Data and content licence
You own your Customer Data. You grant AttendIn a limited licence to host, process, transmit, and display Customer Data to:
- Provide and operate the Platform and its features;
- Prevent fraud, enforce the Agreement, and maintain security;
- Improve and develop the Platform (including analytics and troubleshooting), in accordance with the Privacy Policy and any DPA.
You represent that you have all rights and lawful bases to provide Customer Data to AttendIn and to instruct AttendIn to process it.
8. Feedback and testimonials
If you provide Feedback, you grant AttendIn a perpetual, worldwide, royalty-free right to use and incorporate it to improve the Platform.
If you are a Beta Customer, your plan terms may additionally allow AttendIn to use Feedback as testimonials and marketing content, subject to the attribution and privacy protections described in the Beta terms.
9. Privacy and data protection
We process personal data as described in our Privacy Policy. Where required, we may enter a Data Processing Agreement (DPA) with Organisers (especially on Enterprise).
10. Third-party services
The Platform may integrate with third-party services (for example, email delivery, payment processing, analytics). Third-party terms may apply to those services, and AttendIn is not responsible for third-party services.
11. Fees, billing, and taxes
Fees apply only to paid plans (for example, Pro or Enterprise) as described on the pricing page and/or in an order form. You agree to pay applicable fees, taxes, and charges. If payment fails, we may suspend access until resolved.
12. Intellectual property
AttendIn and its licensors own all rights, title, and interest in the Platform (excluding your Customer Data). These Terms do not transfer any intellectual property rights to you.
13. Suspension and termination
We may suspend or terminate access immediately if we reasonably believe there is a breach of these Terms, a security risk, unlawful activity, or non-payment. You may stop using the Platform at any time.
On termination, your right to access the Platform ends. We may retain or delete Customer Data in line with our retention practices and legal obligations.
14. Disclaimers
The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.
15. Limitation of liability
To the maximum extent permitted by law, AttendIn will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data.
To the maximum extent permitted by law, AttendIn's total liability under the Agreement is limited to the amounts you paid to AttendIn in the 12 months before the event giving rise to the claim (or £100 if you are on a free plan), except where liability cannot be limited by law.
Nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, or any liability that cannot be excluded or limited by law.
16. Indemnity
You will indemnify and hold harmless AttendIn from third-party claims arising from (a) your events, (b) your Customer Data, (c) your communications to invitees/attendees, or (d) your breach of the Agreement.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by posting an update on the Platform or by email). Continued use after the effective date means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction (unless mandatory law provides otherwise).
